Commissioner of Central Excise, Delhi-IV v. M/s. Sandan Vikas (I) Ltd.
Background
The respondent manufactured car air-conditioning kits and classified them for excise duty purposes under a specific exemption entry (serial no. 8) of a 1986 notification. An earlier Supreme Court decision between the very same parties, for an earlier tax period, had held that an air-conditioning kit without its automotive gas compressor falls under that exemption entry, while the compressor itself is taxed separately. In this later appeal, covering a different tax period, 1.8.1991 to 28.2.1993, the tax tribunal ruled in the assessee's favour by applying that earlier decision, and the Revenue appealed, arguing the earlier precedent itself needed reconsideration; a two-judge bench in 2015 referred the matter to a three-judge bench for that reason.
Decision Breakdown
The three-judge bench held that the ratio of the earlier decision was not erroneous but needed clarification: if a manufacturer sells the air-conditioning kit and the automotive gas compressor together as a single transaction/invoice, the combined item falls outside the exemption entry and duty is payable on the whole; but if the kit and compressor are sold separately under separate invoices/pricing, the kit alone continues to qualify for the exemption entry while the compressor is taxed separately. Applying this clarified test to the facts, the Court found it was undisputed that the respondent had in fact sold the kit and compressor separately, which the tribunal had already accepted, so there was no error in the tribunal's order. The appeal was accordingly disposed of on this basis, with the earlier precedent clarified rather than overturned, and no order as to costs.
Lesson Learnt
When a tax exemption depends on how goods are packaged and billed, the key practical factor can be as simple as whether components are invoiced together or separately: businesses should understand that identical goods may attract different duty treatment purely based on how a sale is structured and documented.
