Custodian of Evacuee Properties v. Amjadali Gazanfarali Bukhari
Background
A Gujarat public interest petition concerned property in which Bukhari had already filed his own challenge. The High Court disposed of the public interest case in September 2006, and the State complied through a detailed decision that December. Nevertheless, an application seeking temporary protection became the basis for another hearing and a fresh High Court order in November 2007.
Decision Breakdown
The Supreme Court allowed the appeals and set aside the November 2007 order. The High Court had exceeded the scope of an application seeking status quo while the State decided the matter: that decision had already been made, leaving the application without purpose. Reopening the concluded petition through that application amounted to an abuse of process, particularly because the State's detailed decision had not been challenged. Bukhari had also withdrawn his separate petition after that decision, supporting closure of the public interest litigation.
Lesson Learnt
An application for temporary protection cannot ordinarily reopen a finally disposed case after the required decision has been made; any fresh challenge must follow the proper procedure.
