Director, Printing and Stationary Department, U.P. Government Press v. Moti Lal
Background
Daily-wage Group D workers in the Uttar Pradesh Government Press sought regular appointments after a long-running dispute and government assurances recorded in earlier court proceedings. Recruitment of gatemen under different qualifications left many existing workers unsuccessful and generated fresh litigation.
Decision Breakdown
The Court modified the High Court's order to require identification, within four months, of Group D vacancies arising between 1991 and 2003, excluding gatemen posts. Those vacancies were to be filled within a further month from eligible daily-wage workers in service on 12 November 1997 who still had at least five years before retirement, applying the 1985 qualifications. Existing regular employees, including selected gatemen, were protected, and eligible workers could be accommodated in other State Group D posts. The ordered exercise had to be completed before further regular appointments to those posts in the State.
Lesson Learnt
When a government commitment to absorb specified workers is recorded in court, it must be implemented through the directed eligibility and vacancy exercise rather than left unresolved by different recruitment arrangements.
