G. Rama Sharma v. Govt. of A.P. & Anr.
Background
The appellant had challenged disciplinary proceedings taken against him which had culminated in his termination from government service. By the time the appeal reached final hearing, he had, in the ordinary course of time, already reached the age of superannuation.
Decision Breakdown
Because the appellant had already reached superannuation age, his counsel fairly conceded that the question raised was "only academic" at that stage and that the appellant was no longer interested in pursuing the case for monetary benefits (such as back wages). On that concession, counsel submitted that the civil appeal could simply be disposed of, and the Court ordered accordingly: formally closing the appeal without a reasoned ruling on the merits of the disciplinary action itself.
Lesson Learnt
A service-law challenge can lose its practical value by the time it is finally heard years later if the employee has already reached retirement age and chooses not to press for monetary relief: anyone in such a dispute should consider early whether to specifically seek interim or monetary relief, since a final disposal long after retirement may otherwise amount to little more than closing the file.
