G.T. Venkataswamy Reddy v. State Transport Authority
Background
This judgment answers a question of law; it does not decide the case itself. A question was referred to a Constitution Bench: whether an existing stage-carriage permit can be varied, by adding trips or vehicles, on a route covered by an approved nationalisation scheme under Chapter IV-A of the Motor Vehicles Act, 1939. This appeal was the lead case, heard with nine connected appeals and petitions.
Decision Breakdown
This is not a final judgment in the case itself. The Constitution Bench laid down 14 legal propositions on the question. It held that Karnataka SRTC v. B.A. Jayaram (1984) is no longer good law, and approved Pandiyan Roadways v. Egappan (1987) and Adarsh Travels (1985). Having answered the reference, it directed the Registry to list the cases before the regular Bench for disposal by applying these principles.
Lesson Learnt
The legal question is settled: permit variations cannot override an approved nationalisation scheme under Chapter IV-A. There is no final ruling yet on the appellant's own permit-variation claim, which a regular Bench will decide.
