H.L. Gulati v. Union of India & Ors.
Background
The appellant, a Senior Accounts Officer in the Defence Accounts Department, was accused of enabling 36 fraudulent payment claims worth about Rs.42.24 lakh between 1992-94 through lapses in his duties. A departmental inquiry found some of the charges partially/marginally proved (essentially procedural negligence, not dishonesty), and a parallel criminal prosecution against him ended in his discharge, with the court finding no proof of his complicity or intentional wrongdoing. Despite this, after he retired in 2002, the punishing authority invoked Rule 9 of the CCS (Pension) Rules, 1972 and permanently withheld 50% of his pension and 50% of his gratuity on the basis that he was guilty of "grave misconduct."
Decision Breakdown
The Supreme Court held that the inquiry officer's own findings only supported a conclusion of negligence in discharging his duties, not the more serious "grave misconduct" needed to justify permanently withholding a retired employee's pension under Rule 9. The charge alleging actual complicity or dishonest intent (Article IV) had in fact been found "not proved" by the inquiry officer, and the appellant had also been cleared in the related criminal case on the same facts. Because the punishing authority's finding of "grave misconduct" could not be sustained on the record, the Court set aside the punishment order, but rather than sending the case back for reconsideration (given the long delay since the 1990s events), it used its Article 142 power to directly fix a lighter punishment itself: sustaining the 50% withholding of gratuity, but directing that the 50% withheld pension be restored in full from 1 March 2015 onward.
Lesson Learnt
Before a retired government employee's pension can be permanently withheld as punishment, there must be an actual finding of "grave misconduct" or "grave negligence" properly supported by the inquiry record: a finding of mere negligence, without dishonest intent or complicity, is not enough to justify that severe a penalty.
