IN RE-INHUMAN CONDITIONS IN 1382 PRISONS
Background
This is an interim order, not a final judgment. This public interest case on prison overcrowding and conditions began with a 2013 letter from a former Chief Justice of India. The Court had already passed several interim orders in it during 2015.
Decision Breakdown
This is an interim order, not a final judgment. On 5 February 2016 the Court issued a fresh set of 8 directions, covering matters such as Under Trial Review Committees, prisoner management software and the Model Prison Manual. It issued notice to the Secretary, Ministry of Women and Child Development, on conditions for juveniles in custody, returnable on 14 March 2016. It said the remaining issues, particularly unnatural deaths in jails, inadequacy of staff and training of staff, would be considered on the next date of hearing.
Lesson Learnt
There is no final ruling yet on the petition, which remains pending before the Court. The order is part of the Court's continuing supervision of prison reform.
