Jasbir Kaur v. Satbir Singh
Background
The appellant-wife, appearing in person (assisted by a court-appointed amicus curiae, senior counsel Rana Mukherjee), challenged a Punjab and Haryana High Court order dated 25.11.2009 that had dissolved her marriage to the respondent-husband by a decree of divorce. By the time the matter was heard, both parties confirmed in Court that neither wanted to continue the marital relationship any longer, leaving only the question of whether the divorce decree itself should be disturbed, and separately, the unresolved issue of permanent alimony/maintenance, which had not actually been decided by either the Family Court or the High Court.
Decision Breakdown
Having heard both sides and the amicus curiae, the Supreme Court affirmed the divorce decree granted by the High Court, since both parties no longer wished to maintain the relationship. On the separate, undecided issue of alimony, the Court directed the District Judge/Family Court, Jalandhar, Punjab, the forum with actual jurisdiction over that question, to conduct an inquiry and pass final orders on permanent alimony within three months, rejecting the wife's request that the High Court or Supreme Court itself conduct that inquiry. With the divorce decree affirmed and alimony referred to the proper forum with a firm deadline, the Court held nothing further survived for adjudication in the appeal and disposed of it accordingly, recording its appreciation for the amicus curiae's assistance.
Lesson Learnt
A challenge to a divorce decree and a claim for permanent alimony are distinct issues: the Supreme Court can finally affirm a divorce while directing that maintenance/alimony, which must be assessed on facts like income and needs, be decided by the specialized Family Court within a fixed timeframe rather than by the higher courts themselves.
