Jatinder Kumar Sapra v. Anupama Sapra
Background
The Supreme Court had earlier, on 06.05.2024, allowed the husband's appeal, granted a divorce decree on the ground of irretrievable breakdown of marriage, and awarded the wife permanent alimony of Rs. 50,00,000 payable in five installments. Both sides confirmed the full amount had been paid. The husband then filed this miscellaneous application asking the Court to clarify that this alimony also covered arrears in a separate maintenance case pending before the Family Court, Dwarka, and to have that case closed.
Decision Breakdown
The Court held the application was misconceived. Once the dispute between the parties was finally settled through a lump-sum permanent alimony award, nothing further survived for consideration. It clarified that its earlier judgment had conclusively and finally settled all disputes between the parties, including maintenance, and that the Rs. 50 lakh payment was full and final settlement of all claims. Consequently, the pending Family Court maintenance case stood closed, and no arrears from it could be claimed separately. The application was dismissed as devoid of merit.
Lesson Learnt
Once a court awards a lump-sum permanent alimony as full and final settlement between divorcing spouses, it closes out all connected maintenance claims: a party cannot later try to reopen or supplement that settlement through a fresh application.
