Justice Sunanda Bhandare Foundation v. Union of India
Background
A charitable trust sought effective implementation of the Persons with Disabilities Act, 1995, including teaching opportunities for people with visual disabilities. Despite earlier court proceedings and assurances about university measures, implementation by governments and other responsible authorities remained incomplete many years after the law was enacted.
Decision Breakdown
The Court directed the Central Government, States and Union Territories to implement the 1995 Act immediately and, positively, by the end of 2014. It required the named senior officials and disability commissioners to ensure compliance in all respects, including protections for visually disabled people. Welfare rights could not be left on paper through obstructive or inactive administration. The petitions and connected appeals were disposed of on those terms; the judgment did not appoint any particular person to a job.
Lesson Learnt
Statutory disability rights require actual administrative implementation; responsible authorities must take active steps to make promised opportunities and protections usable.
