Juveria Abdul Majid Patni v. Atif Iqbal Mansoori and Another
Background
A woman alleged physical abuse and exclusion from her matrimonial home before obtaining an ex parte khula from a Mufti. Her husband disputed that divorce, while she sought protection and financial relief under the Domestic Violence Act for herself and their child. The Magistrate ordered interim maintenance of Rs. 25,000, but the Sessions Court and High Court held that her application was barred by the claimed divorce.
Decision Breakdown
The Supreme Court allowed her appeal, restored the Magistrate's interim order and directed payment if it remained unpaid. The lower courts could not treat the divorce as established without the necessary pleadings, evidence and findings. Independently, even assuming divorce had occurred, it did not erase liability or prevent relief for domestic violence committed while the parties lived together. The Magistrate was directed to hear the parties, consider the report and decide the application finally.
Lesson Learnt
A later divorce did not shut out this woman's claim for relief arising from earlier domestic violence. Restoring her application and interim support left the final relief to the Magistrate; the Supreme Court did not itself decide every allegation or award every remedy requested.
