K. K. Dixit v. Rajasthan Housing Board
Background
The housing board's junior engineers included degree holders and diploma holders, with different experience requirements and promotion quotas. Some diploma holders later gained AMIE, an equivalent degree qualification, and claimed that their earlier service counted towards promotion in the degree-holder quota. Degree holders challenged that claim and also sought separate seniority lists.
Decision Breakdown
The Supreme Court held that the three years required for the degree-holder promotion quota must be served after acquiring the degree or AMIE qualification. Earlier diploma service could not satisfy that requirement, although the engineer retained the applicable opportunity under the diploma quota. The Court upheld a common seniority list for the single junior-engineer cadre, distinguishing seniority from separate promotion-eligibility lists. It directed the board to resolve the contested promotions preferably within four months, without reopening earlier regular promotions that had not been challenged.
Lesson Learnt
Acquiring a higher qualification does not automatically convert earlier service into experience under that qualification. Employees must check the specific promotion quota and distinguish eligibility requirements from their existing cadre seniority.
