Kamal Jeet Singh vs. Municipal Corporation of Delhi
Background
After the Bapu Market Tehbazari sites in Chandni Chowk were demolished in 2018 for redevelopment, with vendors slated to be relocated to Mata Sundari Marg, the petitioner claimed entitlement to a new site there. He traced his claim through a 2016 private transfer/partnership arrangement from one Danish Ahmed, who had himself acquired the site from its original 2011 holder.
Decision Breakdown
MCD's own 2009 circular (framed after a Supreme Court ruling) recognizes only those changes of tehbazari "hand" that occurred before 6 February 2007; the transfer relied on here took place in 2016, well after that cutoff, and MCD had formally rejected the petitioner's mutation request on this exact ground in 2022. The Court also noted that Danish Ahmed's own two prior writ petitions over the same site had already failed, one of them expressly for concealment of facts. The petition was dismissed.
Lesson Learnt
A municipality's cutoff date for recognizing informal transfers of licensed vending rights is applied strictly, repeating the transfer through additional private hand-offs afterward does not cure a transfer that falls outside the recognized window.
