Karedla Parthasaradhi v. Gangula Ramanamma
Background
This is an interim order, not a final judgment. A man's brother sought possession of a house after the owner's death, disputing Ramanamma's claim that she was the owner's wife and heir. The High Court accepted her marital status and rejected the brother's claim. Ramanamma died during the litigation, and Sanjiva Rao sought to represent her estate as her adopted son and beneficiary under a will.
Decision Breakdown
This is an interim order, not a final judgment. The Supreme Court upheld the finding that Ramanamma was the owner's wife, taking account of their long association and the evidence of their relationship. However, the courts had not properly investigated Sanjiva Rao's disputed entitlement to represent her estate. The Court retained the appeal and directed the trial court to investigate the alleged adoption, the genuineness of the will and whether it bequeathed the house to him, after allowing the parties to present evidence. The trial court was to send its reasoned findings within three months, following which the Supreme Court would hear the appeal again.
Lesson Learnt
When a litigant dies, a disputed claim to represent the estate requires a proper inquiry. Being substituted in a pending case does not dispense with examining the claimed adoption or will.
