Kerala Transport Development Finance Corporation Limited vs Basil T.K. & Ors. (with connected appeals)
Background
Two employees of the Kerala Transport Development Finance Corporation Limited (KTDFCL) had their initial regularization as Assistant Managers cancelled by the State Government in 2007 on procedural grounds. After prolonged litigation, the Kerala High Court in 2009 directed their reinstatement with "continuity of service" but without back pay for the period they were out of service. A later dispute arose over how this "continuity of service" should be treated when computing their eligibility for promotion (to Deputy Manager, then Manager) against a third employee, Aneesh Babu, who had continued working throughout and claimed he should rank above them in seniority. A Single Judge and Division Bench of the Kerala High Court ruled in the reinstated employees' favour on both back-pay and seniority; KTDFCL and Aneesh Babu both appealed to the Supreme Court.
Decision Breakdown
The Supreme Court clarified that "continuity of service" (as opposed to actual back pay) means that the period the employees were wrongly out of service could still count toward seniority and promotion eligibility, since their termination had been declared illegal and their original regularization dated back to 2006. On seniority, applying the KTDFCL Service Rules (which base seniority on the date of first appointment to a grade), the Court held the reinstated employees, appointed in 2000/regularized in 2006, correctly ranked above Aneesh Babu, who was only appointed in 2008. However, the Court clarified that the employees were not entitled to arrears of salary for the years they were actually out of service (2007-2012), consistent with the earlier 2009 judgment, even though their service would count for promotion purposes. The appeals were disposed of with this clarification, and the Court directed that the next promotion (to Chief Manager) proceed strictly per the applicable Service Rules.
Lesson Learnt
A court-ordered grant of "continuity of service" upon reinstatement is a distinct concept from back pay. It preserves an employee's seniority and promotion eligibility for the period wrongly spent out of service, even where the employee is denied monetary compensation for that same period.
