M.P. Singh Bargoti v. State of Madhya Pradesh and another
Background
A fingerprint-branch police inspector retired without being considered for promotion despite final Tribunal directions requiring a combined seniority list. A junior from another section was later promoted with effect from a date before the inspector's retirement. The inspector sought notional promotion and corresponding pension benefits after the Tribunal and High Court denied relief.
Decision Breakdown
The Court allowed the appeal and granted notional promotion to Deputy Superintendent of Police from May 29, 1997 until retirement on March 31, 1998. The State had not timely implemented the final directions or considered his claim, even while giving a junior promotion effective during his service. Later amended rules and another seniority list did not answer the earlier entitlement. This produced arbitrary discrimination rather than merely an unfortunate delay after retirement. The State had to recalculate and pay retirement benefits and arrears within three months and also pay ₹50,000 costs.
Lesson Learnt
Retirement does not defeat a claim for corrected pension benefits where unlawful failure to consider promotion allowed a junior to receive promotion effective before that retirement. This relief was based on the final earlier directions and the established seniority comparison.
