M/s Gennex Laboratories Ltd. v. Commercial Tax Officer, Hyderabad & Anr.
Background
The appellant company challenged a High Court order which had noted that the company had not availed of the statutory remedy available to it before the Sales Tax Tribunal before approaching the writ court. A connected appeal (Civil Appeal No. 8766 of 2017) involved a related Tribunal order arising from the same dispute and was heard together.
Decision Breakdown
The Supreme Court expressly declined to examine the underlying tax dispute on its merits. Instead, it set aside the High Court's judgment and granted the appellant 30 days to file a statutory appeal before the Sales Tax Tribunal, directing that such an appeal be treated as filed in time if presented within that window. In the connected appeal, the Tribunal's earlier order was set aside and that matter was restored to the Tribunal to be heard together with the newly permitted appeal, with both sides free to raise all their contentions there.
Lesson Learnt
Where a statutory appellate forum (like a tax tribunal) exists for a dispute, courts will often redirect a case there rather than deciding the substance themselves: procedural doors can be reopened by the Supreme Court even after they appear closed, but the underlying merits still have to be argued at the proper forum.
