Nirlon Ltd. v. Commissioner of Central Excise, Mumbai
Background
Nirlon Ltd. manufactured Tyre Cord Yarn (TCY) and Tyre Cord Fabric, selling some at its factory gate and transferring the rest to its own Tarapur unit for further manufacturing ("captive consumption"). It valued the captively-consumed goods at the same price as goods sold to outside buyers. The excise department disagreed, treated the two categories of goods as not comparable, and issued two show-cause notices (in 2000 and 2001) demanding differential duty and penalties, the second of which also invoked the extended (five-year) period of limitation on the ground of alleged suppression. The Tribunal (CESTAT) upheld the demand, leading to this appeal.
Decision Breakdown
The Supreme Court agreed with the tax authorities that the two categories of goods were not truly comparable, so the appellant's valuation method under Rule 6(b)(i) was indeed incorrect and ought to have followed Rule 6(b)(ii). However, on the separate question of limitation, the Court accepted the appellant's explanation, the two kinds of goods used identical raw materials and processes, fell under the same tariff heading, the department had accepted the same price declarations for years, and the entire exercise was revenue-neutral since any extra duty paid would be available as credit, and held there was no mala fide intent to evade duty. It therefore ruled the extended period of limitation could not be invoked, confirmed the duty demand only for the first (non-time-barred) show-cause notice, set aside the time-barred portion of the second notice's demand, and set aside the penalty altogether. The appeal was allowed in part.
Lesson Learnt
Even where a taxpayer's technical valuation method is found incorrect, the extended five-year limitation period and penalties for alleged tax evasion cannot be invoked unless there is actual evidence of fraud or wilful suppression: an honest, revenue-neutral mistake made with the department's long-standing knowledge and acceptance is not enough to establish that intent.
