Panchayat & Rural Development Department & Ors. vs Santosh Kumar Shrivastava
Background
The respondent retired from Madhya Pradesh government service in June 2013 after his pay was revised in 2011, but the department later reversed that pay revision and withheld his pension and gratuity, deducting amounts for alleged penal house rent and excess salary. The department claimed the dues were withheld partly because the respondent had not vacated his official residence. A Single Judge and then a Division Bench of the High Court both ruled the recovery illegal and directed payment with 6% interest.
Decision Breakdown
The Supreme Court dismissed the department's appeal, holding that pension and gratuity are earned rights, not a bounty, and cannot be withheld absent clear statutory justification. It found no logical connection between the respondent's continued occupation of the government residence and his separate, accrued entitlement to retiral dues: the two issues arise from entirely different legal relationships. The Court also reaffirmed that recovery of any "excess" payment is barred where the employee did not obtain it through fraud or misrepresentation. It upheld the interest awarded on the delayed payments.
Lesson Learnt
An employer cannot hold pension or gratuity hostage to unrelated disputes, such as an employee's failure to vacate official housing; retiral benefits are a vested right that must be paid promptly once earned.
