Panchraj Tiwari v. M.P. State Electricity Board and Others
Background
A graduate junior engineer employed by a rural electricity cooperative society was absorbed into the Madhya Pradesh State Electricity Board when the society merged with it in March 2002. The merger protected his designation and pay, but the Board treated him as permanently ineligible for promotion within its service. The High Court accepted that interpretation, and he appealed.
Decision Breakdown
The Court held that genuine absorption into a single service could not leave the society's employees permanently outside the promotional structure. They were to be placed, from 15 March 2002, below the Board's junior-most employees in the corresponding categories, with their relative positions determined by their appointments or promotions in the societies. Thereafter they had to be considered for promotion under the Board's rules. Tiwari received retrospective promotional entitlement corresponding to the junior-most graduate engineer's promotion dates, with benefits up to the judgment worked out notionally. Other absorption conditions remained, but promoted employees could be transferred outside their circle when service needs required.
Lesson Learnt
An employee absorbed into an integrated service is entitled to appropriate seniority and consideration for promotion, even though a particular rank or promotion is not guaranteed. Protected pay and designation cannot justify permanently denying every opportunity to advance.
