Prabhu Bagai & Ors. vs. State of NCT of Delhi & Anr.
Background
The petitioners (husband's family) sought quashing of an FIR under Sections 498A/406/34 IPC, filed by the petitioner's former wife. The marriage had already ended in divorce, with no children, and the complainant stated she had received the complete and final settlement of her stridhan and maintenance claims.
Decision Breakdown
The State raised no objection, and the complainant appeared via videoconferencing, was identified by the investigating officer, and personally confirmed (in Hindi) that she had settled all disputes and no longer wished to pursue the case. Satisfied that a trial would serve no purpose, the Court quashed the FIR and all related proceedings.
Lesson Learnt
When a matrimonial criminal case has been genuinely and fully settled, courts can quash the FIR to spare both sides a pointless trial, but only after the judge personally verifies, directly with the complainant, that the settlement is real and voluntary.
