Praful Shukla and Others vs Government of Madhya Pradesh and Others
Background
Employees of the state's Adult Education Department challenged a 1999 government order that merged their department's staff into the Education Department and fixed seniority category-wise. Both the Single Judge and the Division Bench of the Madhya Pradesh High Court had upheld the merger, finding the merged posts to be at an equivalent level with pay scales eventually brought at par. The employees then appealed to the Supreme Court.
Decision Breakdown
The Supreme Court noted that a cadre merger is a policy decision that courts generally do not interfere with, especially once it is shown that the merged posts carried comparable responsibilities and pay. It also observed that most of the 17 original petitioners were far down the seniority list, meaning the officers who would have been most immediately affected by the merger never objected to it, and that 24 years had passed with many affected employees having since been promoted or retired. Finding no reason to disturb the High Court's judgment, the Court dismissed the appeals.
Lesson Learnt
Courts are reluctant to strike down bona fide government policy decisions like cadre mergers, particularly where the affected employees did not object promptly and decades have passed, altering the practical stakes for those involved.
