Rajasthan Rajya Vidyut Vitran Nigam Ltd. v. Dwarka Prasad Koolwal
Background
Rajasthan electricity employees who remained in the contributory provident fund scheme sought another chance to switch to pension and general provident fund benefits. The employer had issued eight opportunities over eight years. The employees claimed ignorance of the option, and the High Court granted broad relief after pension calculations later became more advantageous.
Decision Breakdown
The Court allowed the employer's appeals and set aside the general entitlement to another switching opportunity. The regulations prescribed a time limit and treated failure to opt as remaining in the existing scheme. Repeated publicised opportunities and employee conduct supported knowledge, and a later improvement in pension calculations did not require a new option. Employees could not switch schemes whenever one became more attractive. Three distinct cases alleging timely submitted options or related deductions required individual fact-finding, so Civil Appeal Nos. 7503, 7570 and 7564 of 2014 were remitted to a High Court single judge for fresh consideration.
Lesson Learnt
Employees should exercise benefit-scheme options within the prescribed time and keep proof of submission. Later financial advantages do not automatically reopen a deadline, although a genuinely timely application may require separate examination.
