Ram Kumar Gijroya v. Delhi Subordinate Services Selection Board
Background
The appellant applied for the post of Staff Nurse under the OBC reserved category but submitted his OBC certificate only ten days before the application deadline; his name was later left off the final selection list because the certificate was considered to have been obtained/submitted too close to the cut-off. A single judge of the Delhi High Court had ordered the Selection Board to reconsider his case, relying on an earlier ruling (Pushpa's case) involving the same recruitment notice, but a Division Bench of the High Court reversed that order, distinguishing his case on the timing of the certificate.
Decision Breakdown
The Supreme Court held that the Division Bench erred by not following the binding reasoning in Pushpa's case and in related precedents (including the Constitution Bench rulings in Indra Sawhney and Valsamma Paul), which establish that a candidate's caste/category status exists from birth and a certificate merely affirms a pre-existing fact, so requiring the certificate to be dated before an arbitrary cut-off, when it is submitted before the provisional selection list is published, serves no rational purpose and defeats the constitutional object of reservation under Articles 14, 15 and 16. Because the object of reservation is to give genuinely equal opportunity to historically disadvantaged candidates, rejecting a candidate purely for the late timing of the certificate (while he was otherwise eligible) was not justified. The Court therefore set aside the Division Bench's ruling and restored the single judge's order directing reconsideration of the appellant's OBC claim, allowing the appeal with no costs.
Lesson Learnt
If you belong to a reserved category by birth, a minor delay in submitting your category certificate, as long as it reaches the authorities before the provisional selection list is finalized, should not by itself disqualify you from a reserved post; courts look at whether the delay actually defeats the purpose of reservation, not just at the calendar.
