Ramakanth V v. Purnima & Anr.
Background
A husband and wife had been locked in matrimonial litigation for eleven years, spanning a divorce petition, debt recovery tribunal proceedings, criminal complaints, and a dispute over an ICICI Bank home loan, with the appeal before the Supreme Court arising from a High Court order in one of these connected matters. The Court appointed a mediator, and after extensive mediation sessions the parties reached a comprehensive written settlement dated 12 December 2017, with ICICI Bank also joined as a party to resolve the outstanding home loan dues.
Decision Breakdown
The Supreme Court recorded that the husband had paid Rs. 40 lakh plus further demand drafts for Rs. 48.35 lakh to the wife in full and final settlement of amounts due to her. On the remaining home-loan dispute, the Court directed ICICI Bank to accept a reduced one-time settlement of Rs. 15 lakh (against a claimed Rs. 75.75 lakh) to be paid jointly by the parties, with the bank then required to mark the loan "settled as paid in full" and issue no-dues/no-objection certificates. Pursuant to the settlement, the Court dismissed five connected civil, debt-recovery, and criminal proceedings between the parties and quashed a pending criminal complaint (under Sections 420/406/468/471 IPC), directing that neither party could institute further proceedings against the other over these disputes without the Court's express permission.
Lesson Learnt
Long-running matrimonial litigation that has spilled into multiple civil, financial, and criminal forums can often be resolved more effectively through court-supervised mediation and a single comprehensive settlement than through continued separate adversarial proceedings.
