Sarvani & Ors. v. Municipal Board, Navalgarh
Background
The first appellant's husband died while still in the service of the Municipal Board, Navalgarh, and a dispute arose over the dues and benefits owed to the family on account of his service. The matter reached the Supreme Court by way of a civil appeal after proceedings in the lower courts.
Decision Breakdown
Rather than adjudicating the detailed service-dues claim, the Supreme Court used the peculiar facts of the case, the husband's death while in service, to order a one-time lump-sum payment of Rs. 2,00,000 to the family in full and final settlement of all claims relating to his service, to be paid within four weeks. The Court added that if the amount was not paid within that period, the appellant would be entitled to 18% interest running from the date of the husband's death.
Lesson Learnt
In hardship cases arising from a government or municipal employee's death in service, the Supreme Court can bypass a prolonged dispute over exact entitlements and instead order a fixed, one-time compensation to bring the matter to a quick and final close for the bereaved family, with a strong interest penalty built in to discourage delay in payment.
