Secretary, Department of Personnel, Public Grievances and Pension v. T.V.L.N. Mallikarjuna Rao
Background
Data Entry Operators Grade A sought the higher Grade B pay scale of ₹1,350-2,200 from January 1986. Tribunals granted their claims and High Courts affirmed, relying on similarity of work or qualifications and service experience. The Union challenged those decisions against the backdrop of a government restructuring of electronic-data-processing posts.
Decision Breakdown
The Court found a valid distinction between entry Grade A and Grade B, based on recruitment qualifications, promotional experience, duties and responsibility. Courts could review unconstitutional classification but could not replace an expert pay structure merely because tasks appeared similar. Holding a graduate qualification or completing the period making an employee eligible for promotion did not itself confer appointment or pay in the higher grade. The Court held the respondents not entitled to the claimed scale on those grounds, set aside the tribunal and High Court orders and allowed the appeals.
Lesson Learnt
Similar tasks, an additional qualification or eligibility for promotion do not automatically entitle an employee to another grade's pay. An equal-pay claim must address the actual qualifications, responsibilities and recruitment structure and show why the distinction lacks a reasonable basis.
