Secretary to Government, School Education Department, Chennai v. Thiru R. Govindaswamy and Others
Background
Part-time school sweepers obtained High Court directions converting their service into full-time regular employment after long periods of work. The government implemented the orders but appealed to prevent them being used as a general precedent. It expressly stated that it did not wish to disturb these employees' regularised service.
Decision Breakdown
The Supreme Court allowed the appeals on the legal issue. Long service by part-time workers did not by itself establish appointments to sanctioned regular posts or a right to permanent absorption and equivalent pay. The High Court's general regularisation approach conflicted with the governing public-employment principles. Nonetheless, because the orders had already been implemented and the employer accepted the existing arrangements, the Court preserved these respondents' regularised employment.
Lesson Learnt
Exceptional protection for people already regularised does not create the same entitlement for all part-time employees. A claim to a permanent public post must be grounded in the recruitment framework and sanctioned employment, rather than length of service alone.
