Senior Divisional Manager, Life Insurance Corporation of India Ltd. & Ors. v. Shree Lal Meena
Background
This is a referral order, not a final judgment. An employee of the Life Insurance Corporation sent letters seeking voluntary retirement in June 1990 and then resigned in July 1990, which the Corporation accepted. He later claimed pension under the LIC (Employees) Pension Rules, 1995, and the question was whether a resignation can be treated as voluntary retirement under Rule 31.
Decision Breakdown
This is a referral order, not a final judgment. The Court said it was unable to concur with the earlier decision in Asger Ibrahim Amin v. LIC (2015). It directed that the matter be placed before the Chief Justice of India for constitution of a larger bench. Until the question is decided, the Corporation must pay the respondent 50% of the pensionary amount from 1 December 2015.
Lesson Learnt
There is no final ruling yet on whether an employee who resigned is entitled to pension under these Rules. Only an interim payment of 50% has been directed.
