Sita Soren vs Union of India
Background
The appellant, a Jharkhand Mukti Morcha MLA, was accused of accepting a bribe from an independent candidate in exchange for her vote in a 2012 Rajya Sabha election, but ultimately voted for her own party's candidate instead (the election was later annulled and re-held, in which she again voted for her party's candidate). She sought to quash the criminal proceedings against her, claiming immunity under Article 194(2) of the Constitution based on the Supreme Court's 1998 five-judge decision in P.V. Narasimha Rao, which had held that a legislator who casts a vote after taking a bribe is immune from prosecution. The Jharkhand High Court rejected her claim (since she hadn't actually voted for the bribe-giver), and the matter eventually reached a seven-judge bench to reconsider whether P.V. Narasimha Rao was correctly decided.
Decision Breakdown
The seven-judge Constitution Bench unanimously overruled P.V. Narasimha Rao, holding that a legislator who accepts a bribe in connection with a vote or speech in the House does not enjoy immunity under Articles 105(2)/194(2), regardless of whether they ultimately vote as promised. The Court reasoned that parliamentary privilege exists to protect the independence and integrity of legislative functioning, not to shield corruption; bribery is complete the moment illegal gratification is accepted and is not "essential" to the act of voting or speaking. It also held that the earlier ruling produced an absurd result (protecting a legislator who took a bribe and voted as promised, while exposing one who took a bribe but voted independently) which was contrary to constitutional text and purpose. The Court further clarified that courts and the House exercise parallel, independent jurisdiction over such allegations.
Lesson Learnt
No public office comes with a license to be bribed: parliamentary and legislative privilege protects free debate and voting, not the acceptance of bribes, and a legislator can be criminally prosecuted for taking a bribe even if they never delivered on the corrupt bargain.
