Soumik Sil v. Subhas Chandra Sil
Background
A mother and son sued to protect their use of rooms in the family premises. Following the parents' divorce proceedings, the mother surrendered those rooms under the High Court's order and withdrew as a plaintiff, but the son sought to continue the original suit.
Decision Breakdown
The Court dismissed the son's appeal and upheld rejection of the plaint. Reading the original pleading as a whole, even assuming its statements were correct, it disclosed no remaining independent claim after the rooms were surrendered and the mother's name removed. The son's separate assertions of rights under a trust deed were not the basis pleaded in this suit. He had already brought another suit asserting those rights, so rejecting this plaint did not decide the merits of that separate title claim.
Lesson Learnt
A civil suit must disclose a live claim in its own pleadings; a different property-right argument cannot keep an exhausted suit alive merely by being raised on appeal.
