State of Madhya Pradesh v. Ramanand Pandey
Background
An agricultural-department employee was promoted and transferred from Bhind to Sagar. He did not join at Sagar, returned the promotion order and invoked a purported complaint against him while seeking to remain at Bhind. After his promotion was cancelled, he waited nearly two years before challenging the cancellation.
Decision Breakdown
The Supreme Court allowed the State's appeal and dismissed the employee's writ petition. The High Court had addressed whether pending disciplinary proceedings could prevent promotion, although he had already been considered and promoted. The actual issue was his refusal to accept the new posting, not an inquiry used to withhold promotion. On these facts, his conduct justified cancellation and his later explanation was an afterthought. The Court observed that an earlier clarification from the department would have been preferable, but did not treat its absence as making this cancellation unlawful.
Lesson Learnt
A promotion tied to a new posting may be lost if you refuse to join and return the order. Challenge a posting or seek clarification promptly rather than assuming you can keep the promoted title at your preferred location.
