State of Punjab and Others v. Rafiq Masih (White Washer) and Others
Background
Employees received pay or allowances exceeding their entitlement because their employers made calculation or classification mistakes. None had procured the excess payments through fraud, misrepresentation or participation in the mistake. The employers sought repayment, raising the question of when recovery would create unfair hardship.
Decision Breakdown
The Court held that absence of employee fault alone did not protect every mistaken payment from recovery. It identified protected situations including Class III or IV employees, retirees and people due to retire within one year, payments extending over more than five years before recovery, and employees wrongly assigned and paid for higher duties. It also allowed protection where recovery would be so harsh or inequitable that it outweighed the employer's interest. Punjab accepted that all cases in the batch fell within the identified categories. The Court therefore upheld the High Court orders quashing recovery and disposed of the appeals.
Lesson Learnt
An innocent employee may be protected against recovery of an employer's pay mistake when the identified hardship conditions apply. The ruling concerns recovery of past excess payments; it does not give every employee a continuing right to the mistaken higher salary.
