State of Rajasthan vs. Ashok Khetoliya & Anr.
Background
The Rajasthan government issued a notification in 2014 declaring Gram Panchayat Roopbas in Bharatpur district as a Municipal Board, using its powers under the Rajasthan Municipalities Act, 2009. The respondents challenged this before the Rajasthan High Court, arguing that before such a declaration, a separate notification was first required specifying the area as a "transitional area" under Article 243Q(2) of the Constitution. The High Court agreed and struck down the notification for lack of such a separate notification, relying on an earlier Supreme Court ruling (Champa Lal) that had taken the same view. The State appealed to the Supreme Court.
Decision Breakdown
The Supreme Court held that Part IXA of the Constitution (introduced by the 74th Amendment) does not take away the State Legislature's power to make its own laws on local government. It only requires that state laws not be inconsistent with the constitutional scheme. Examining the Rajasthan Municipalities Act, the Court found that Section 5 (which allows the State to directly establish a Municipal Board) is not inconsistent with Article 243Q, so no separate, distinct notification specifically under Article 243Q was needed before issuing a notification under the State Act. The Court held that the earlier decision in Champa Lal, which required two separate notifications, did not correctly reflect the constitutional scheme and was out of step with a later three-judge bench ruling on the same Part IXA framework. Since the notification declaring Roopbas a Municipal Board followed the State law correctly, the High Court's order striking it down was erroneous and was set aside, restoring the notification.
Lesson Learnt
States retain full legislative power to organize and reorganize local bodies (municipalities, panchayats) under their own laws, as long as those laws are not inconsistent with the constitutional framework: a separate constitutional-level notification is not always a precondition for a valid state government notification creating a municipal body.
