State of Uttaranchal v. C.S.R.K.S. Medical Health Services
Background
Employees challenged written and typing tests used for promotion from Group D posts to junior clerical posts. They relied on rules requiring promotion by seniority, subject to rejection of employees who were unfit. The High Court struck down two government orders providing for the tests.
Decision Breakdown
The Supreme Court allowed the State's appeals and upheld the two government orders. Seniority governed the order of promotion, but the rules also allowed assessment of minimum fitness for the new duties. Experience in a Group D job did not automatically demonstrate suitability for clerical work. The tests here assessed fitness rather than replacing seniority with a competition based on relative merit, so they were consistent with the rules.
Lesson Learnt
A seniority-based promotion rule may still require proof of minimum suitability for the higher post. Passing a fitness test and outranking colleagues on comparative merit are different requirements; the governing service rules decide which applies.
