Background

This order does not decide the main case. Sumangal Holdings challenged a direction to deposit Rs. 6.5 crore pending a dispute over whether Order XVA of the Civil Procedure Code, on arrears of rent and mesne profits, applied to a Small Causes Court suit in Maharashtra. By the time of the hearing the deposit had been made and the suit was proceeding to trial.
