Suresh Kumar Dagla v. Sarwan
Background
Sarwan executed a registered sale deed in 1992 and subsequently complained that the purchaser had obtained it by deception. Years after that criminal complaint failed, he filed a civil suit seeking a declaration of title and cancellation of the sale deed. The purchaser sought rejection of the suit as time-barred, but the trial court and High Court refused.
Decision Breakdown
The Supreme Court allowed the purchaser's appeal and dismissed the suit as barred by limitation. Sarwan's earlier complaint established that he knew about the disputed sale deed in 1993, despite the later plaint claiming that the cause of action arose in 2006. The Court held that this prior knowledge defeated the attempt to treat the civil challenge as timely and that the cited land-revenue provision did not save it. It set aside the lower courts' orders and allowed the application under Order VII Rule 11 of the Civil Procedure Code.
Lesson Learnt
A person disputing a sale deed must bring the civil challenge within the applicable time limit. Pursuing a criminal complaint about the same transaction does not, by itself, make a much later civil suit timely.
