Swami Vedvyasanand Ji Maharaj (D) Thr LRs vs Shyam Lal Chauhan & Ors.
Background
A title suit over land in Bihar was decreed in favour of the plaintiffs on first appeal, and the losing defendant, a religious head ("Swami Shivdharmanand"), filed a pending Second Appeal before the Patna High Court. After he died, two rival successors to his religious seat ("Gaddi") each claimed to be his legal representative entitled to continue the appeal. Over several rounds, including an earlier trip to the Supreme Court that sent the matter back for a fresh decision, the High Court kept ruling on who should be substituted, but one of the two rival claimants himself died in the meantime, and his own successor's plea to step in and to recall the High Court's order was rejected without being properly considered.
Decision Breakdown
The Supreme Court held that the true purpose of substituting a legal representative is only to allow the case to continue. It does not by itself decide anyone's title to the property. It found that the Patna High Court had misapplied Order 22 Rule 5 CPC: a trial court's enquiry report on who is the legal representative is meant only to assist the High Court, not to substitute for the High Court's own reasoned decision, and objections filed against that report must actually be considered. Because the High Court had decided the substitution question after one claimant's death without weighing the pending application of his successor or the objections on record, its orders were procedurally unsound. The Court set aside both High Court orders (dated 19.06.2019 and 30.01.2019) and remitted the matter for a fresh decision, expressly not commenting on whose claim to the "Gaddi" or the estate was actually stronger.
Lesson Learnt
Being allowed to represent a deceased litigant's estate in ongoing court proceedings is a procedural step to keep a case alive. It is not, by itself, a finding about who owns the disputed property or inherits the estate; courts must still decide that separately and give reasoned consideration to all objections before substituting anyone.
