The Commissioner of Income Tax-8 v. M/s N.S.N. Jewellers Pvt. Ltd.
Background
The Income Tax Department filed a civil appeal against M/s N.S.N. Jewellers Pvt. Ltd. The Supreme Court first condoned a delay in filing. It was then pointed out that the tax effect involved in the appeal was below Rs. 25,00,000 (Rs. 25 lakh), the monetary threshold below which the Central Board of Direct Taxes' (CBDT) own circular directs the Department not to pursue appeals.
Decision Breakdown
Applying the CBDT circular on low tax-effect cases, the Supreme Court dismissed the Department's civil appeal on that threshold ground alone, without going into the substantive tax question. It expressly kept the underlying question of law open, meaning the legal issue itself can still be litigated and decided in a future case with a higher tax effect; a connected interim application (I.A. No. 2 of 2016) was also disposed of.
Lesson Learnt
Tax authorities are bound by their own internal circulars on monetary thresholds for filing appeals: an appeal can be dismissed purely because the amount in dispute is too small to justify litigation, even while the legal question itself remains unresolved for future, higher-value cases.
