Union of India & Anr vs. Sukh Varsha
Background
The Union of India challenged an order of the Central Administrative Tribunal that found it in continued non-compliance with an earlier 2023 direction to pay a retired employee's "retiral dues" along with interest, specifically because interest had never been paid on his leave-encashment amount, despite the dues themselves eventually being paid after the employee's 2021 retirement.
Decision Breakdown
The Court held there was no real dispute that leave encashment is part of "retiral dues" payable on retirement, so the Tribunal's 2023 order requiring interest on delayed retiral dues necessarily covered the leave-encashment interest too: a conclusion the Union of India had never even challenged in the two years since. Since the Tribunal had only directed compliance (with a modest cost warning) rather than initiating contempt, and the writ petition had been filed suspiciously just before the compliance deadline, the Court found no reason to interfere and dismissed the writ petition.
Lesson Learnt
Delayed payment of an employee's retiral dues (including leave encashment) ordinarily attracts compensatory interest, and government departments cannot avoid this simply by arguing no specific rule mentions interest on that particular component.
