Union of India & Ors. v. Vishav Priya Singh
Background
This order sends the case back; it does not decide the dispute. The Delhi High Court had quashed the Summary Court Martial convictions of several soldiers, including the respondent, solely on the ground that only the Commanding Officer of a soldier's own unit, and not of a unit he was attached to, could lawfully convene a Summary Court Martial under the Army Act, 1950. The Union of India appealed in nine civil appeals decided together.
Decision Breakdown
This is not a final decision on the dispute. The Court decided only the general legal question, holding that the Commanding Officer of an attached unit can also competently convene a Summary Court Martial in appropriate circumstances. It overturned the High Court's legal reasoning, sent the matters back to the High Court and restored the writ petitions to the High Court's file for consideration on merits.
Lesson Learnt
The Commanding Officer of a unit to which a soldier is attached can convene a Summary Court Martial in appropriate circumstances. There is no final ruling yet on whether this respondent's own court martial should be upheld or quashed.
