Union of India and others v. Tilak Raj Gandhi
Background
A candidate shortlisted for BSNL's Director (Finance) post was not appointed while a CBI inquiry was pending against him. The recruitment ended and a later selection proceeded, for which he did not apply. After the inquiry closed, the High Court directed his appointment when the incumbent retired.
Decision Breakdown
The Supreme Court allowed the government's appeal and set aside the appointment direction. It found that the decision taken while the inquiry was pending did not give the candidate a subsisting right to appointment after that recruitment had ended. Later clearance could not revive the old selection or exclude other eligible candidates from a fresh competition. As special relief, however, the Court directed that if he applied under the next advertisement, his candidature should be considered alongside others even if he had crossed the upper age limit.
Lesson Learnt
Being shortlisted does not guarantee appointment to a later vacancy after the selection has closed. A person whose circumstances change should apply in the new recruitment; relief allowing consideration still leaves selection to a fair comparison of candidates.
