Vice Chairman & Managing Director, A.P. State Essential Commodities Corporation Ltd. & Anr. v. C.V. Viswanatham & Anr.
Background
The respondent, a former employee of the A.P. State Essential Commodities Corporation, had obtained a judgment in his favour against the Corporation (the appellant), which the Corporation challenged before the Supreme Court. The respondent had already attained the age of superannuation and had worked for only about five or six years before retiring. Separately, contempt proceedings had been initiated against the Corporation for alleged non-compliance with the earlier order, and the Corporation sought a stay of those contempt proceedings pending the appeal.
Decision Breakdown
Considering that the respondent had worked only a short period before retirement, the Supreme Court modified the impugned judgment to require the appellants to pay a lump sum of Rs. 2 lakhs to the respondent within three months, in addition to Rs. 1 lakh already paid, as full and final settlement of his entire claim. The appeal was accordingly disposed of as allowed in these modified terms, with no order as to costs. Because the main matter was thereby finally resolved, the Court held there was no longer any basis for the contempt proceedings and quashed them, disposing of the related interlocutory application as well.
Lesson Learnt
Courts can and do convert a disputed service claim into a fixed, one-time monetary settlement to bring finality to protracted litigation, factoring in practical realities like how little time the employee actually worked, and once the underlying dispute is finally settled, any contempt proceedings tied to the earlier order fall away automatically.
