Vijay Prakash Jarath v. Tej Prakash Jarath
Background
Tej Prakash Jarath sued his father and elder brother (Vijay Prakash Jarath) in 1992; after issues were framed in the suit in October 1993, the father and brother filed a counter-claim roughly two-and-a-half years later, in June 1996, which the trial court accepted. The Uttarakhand High Court later struck down that counter-claim as not legally maintainable, relying on an earlier Supreme Court ruling (Rohit Singh's case), reasoning that a counter-claim filed so long after the written statement could not be entertained. The brother and father appealed to the Supreme Court; a connected appeal involving the same family and an identical legal question was also listed together.
Decision Breakdown
The Supreme Court held that under Order VIII Rule 6-A CPC, what matters for maintainability of a counter-claim is not how much time has passed since the written statement was filed, but whether the cause of action for the counter-claim arose before the defendant filed his written statement (or even after, but before the defense was concluded), and here it was undisputed that the cause of action had arisen before the written statement was filed on 11.11.1992. The Court found the High Court had wrongly applied Rohit Singh's case, since no real prejudice or irreparable loss to the plaintiff was shown from allowing the counter-claim to be tried along with the main suit (trial evidence was still being recorded when it was filed). It therefore set aside the High Court's order, restored the trial court's 1996 order accepting the counter-claim, allowed both the appeals, and disposed of the connected appeal on identical terms since the parties agreed it raised the same issue.
Lesson Learnt
A counter-claim filed late in a civil suit is not automatically barred: what the law actually requires is that the cause of action for it arose before (or shortly after, consistent with the rules) the defendant filed his written statement; mere delay in filing it, without real prejudice to the other side, is not grounds to reject it.
