Brihanmumbai Electric Supply & Transport Undertaking v. MERC
Background
Mumbai consumers wanted to switch from BEST to Tata Power. BEST refused permission to use its distribution network and argued that Tata Power could not supply or extend its network within BEST's area. The regulator and electricity tribunal rejected those arguments, prompting BEST's appeal.
Decision Breakdown
The Court dismissed the appeal with costs. Tata Power was a deemed distribution licensee for the overlapping area under the applicable licence framework. BEST's local-authority status allowed it to refuse use of its own wires by another supplier, but did not confer a monopoly preventing Tata Power from supplying through its own network. Tata Power remained obliged to supply applicants and extend its network where necessary, subject to the statutory conditions. The separate cross-subsidy surcharge dispute with another licensee was expressly left undecided.
Lesson Learnt
Where two authorized electricity suppliers serve an area, the local-authority supplier cannot necessarily block a customer's choice of the other. However, a right to alternative supply does not always include a right to use the first supplier's wires.
