Elegna Co-Op. Housing and Commercial Society Ltd. v. Edelweiss Asset Reconstruction Company Limited & Anr.
Background
A lender pushed a real-estate developer into insolvency after a settlement agreement was allegedly breached; a homebuyers' society sought to intervene but was refused standing, and the developer argued the project was nearly finished.
Decision Breakdown
The Supreme Court held that once a genuine debt and default are proven, admission into insolvency is essentially mandatory: a near-complete project or homebuyer inconvenience are separate matters for inside the process, not grounds to refuse admission. A housing society, as a distinct legal entity, cannot claim individual homebuyers' creditor rights on their behalf. The Court did direct forward-looking homebuyer-protection measures.
Lesson Learnt
A company usually cannot avoid formal insolvency proceedings just by pointing to good prospects; a residents' welfare society doesn't automatically get standing in a builder's insolvency case on its members' behalf.
